The Service is operated by Jaro Cech, registered in Czech Republic with address V lukach , 25262 Statenice, Czech Republic and contact support@quizzy.io. References to “quizzy.io”, the “Service”, or the “Platform” mean our websites, apps, APIs, and related services.
2) Agreement to Terms
By creating an account, accessing, or using the Service, you accept these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Service.
3) Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you must have a parent/guardian’s consent. If you use the Service on behalf of an organization, you warrant you have authority to bind that organization and “you” includes that organization.
4) Accounts & Security
You are responsible for your account credentials and all activity under your account.
Keep your password secure and notify us immediately of any unauthorized use.
We may suspend or terminate accounts that violate these Terms.
5) Description of the Service (AI-generated quizzes)
The Service helps you create, share, and play AI-generated quizzes across multiple languages. Outputs are generated by algorithmic models and may be inaccurate, biased, incomplete, or inappropriate. Always independently review important results. Do not rely on the Service for high-risk purposes (e.g., medical, legal, financial, safety-critical, or examinations).
6) Your Content & License to Us
Your Content includes prompts, text, files, images, and any materials you upload or input.
You retain all rights to Your Content.
You grant us a <b>worldwide, non-exclusive, royalty-free</b> license to host, reproduce, process, translate, adapt, and display Your Content <b>solely to provide and improve the Service</b>, including generating outputs for you, maintaining backups, and enabling sharing features you choose.
If you make Content public or share links, you authorize us to display it to others as configured by you.
You represent that you have all rights necessary to submit Your Content and that it does not infringe third-party rights or applicable law.
7) Generated Output
Subject to third-party rights and applicable law, we assign to you our rights, if any, in the Output generated specifically from Your Content and prompts, so you may use it for any lawful purpose, including commercial, subject to: (a) compliance with these Terms and law; (b) respect for others’ rights; and (c) any model/vendor restrictions disclosed to you. Some outputs may be similar to content generated for others. We do not guarantee uniqueness or accuracy.
8) AI Providers & Data Processing
We may process Your Content and account data using our infrastructure and/or third-party AI processors (e.g., model providers, hosting, analytics). We contractually require such processors to protect your data and use it only to provide the Service. See the Privacy Policy for details, retention periods, and opt-in/opt-out choices. Do not upload confidential or sensitive data unless you have appropriate rights and safeguards.
9) Acceptable Use
You agree not to:
Violate any law, or infringe intellectual property or privacy rights.
Upload or generate unlawful, harmful, hateful, harassing, or sexually explicit content; or content exploiting minors.
Attempt to re-identify individuals, or process special-category personal data without lawful basis and consent.
Reverse engineer, scrape, spam, or overload the Service; bypass access controls; or probe vulnerabilities.
Use outputs to cheat on exams or assessments, or to spread misinformation.
Misrepresent outputs as human-authored where disclosure is legally required.
10) Plans, Billing & Trials (if applicable)
Paid plans may be offered on a subscription basis. Prices, features, and limits are shown at checkout or within the account settings.
Subscriptions auto-renew each period unless cancelled before the renewal date.
Taxes are additional where applicable.
Unless stated otherwise, fees are non-refundable; mandatory consumer rights remain unaffected.
We may change prices or features with prior notice; changes take effect at the next billing cycle.
11) Intellectual Property
All rights in the Service and brand (including the quizzy.io name, logos, design, software, and databases) are owned by us or our licensors. Except for the limited license in Section 6 and your rights in Your Content and Outputs, no rights are transferred to you.
12) Feedback
If you provide suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it without obligation to you.
13) Privacy
Our Privacy Policy explains how we collect and use personal data, including the use of cookies and AI providers. By using the Service, you consent to those practices.
14) Service Changes & Availability
We may modify, suspend, or discontinue features or the Service (in whole or part) with reasonable notice where practical. We aim for high availability but do not guarantee uninterrupted service.
15) Third-Party Links
The Service may include links to third-party sites or services. We are not responsible for their content, policies, or practices.
16) Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. AI OUTPUTS MAY BE INACCURATE OR OFFENSIVE. YOU USE THE SERVICE AT YOUR OWN RISK.
17) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR €100 IF YOU USED THE FREE SERVICE.
18) Indemnification
You will defend, indemnify, and hold us harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or applicable law.
19) Term; Termination
You may stop using the Service at any time and cancel subscriptions via your account. We may terminate or suspend access if you materially breach these Terms. Upon termination, Sections 6–8 and 11–22 survive.
20) Changes to Terms
We may update these Terms from time to time. We will post the updated version and, where required, notify you. Your continued use after changes become effective constitutes acceptance.
21) Governing Law & Dispute Resolution
These Terms are governed by the laws of Czech Republic, excluding its conflict-of-law rules. Courts located in Prague, Czech Republic will have exclusive jurisdiction. Consumers located in the EU/EEA may also have mandatory rights to bring claims in their country of residence.
22) Export & Sanctions Compliance
You represent that you are not located in, under the control of, or a national/resident of any country or party subject to embargoes or sanctions that would prohibit your use of the Service. You agree to comply with applicable export control laws.
